1. Acceptance of Terms

By accessing or using AgricVue AI (the "Service"), operated by Time Hole Technologies Limited ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

AgricVue AI is an intelligent farm management platform that provides:

• Satellite-based vegetation monitoring and health analysis
• Multi-criteria land suitability assessments for various crop types
• AI-generated agricultural reports and recommendations
• Weather advisories and alert notifications
• Crop disease detection from imagery
• Historical trend analysis and climate projections
• Agricultural credit scoring (via authorized API partners)

3. User Accounts

You must register for an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary.

4. Subscriptions and Payments

Some features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees. Subscription fees are billed in advance on a monthly or annual basis depending on your selected plan. Payments are processed through Stripe or Paystack.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or its infrastructure
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use automated tools to scrape or extract data from the Service beyond normal API usage
• Resell or redistribute the Service without our written consent
• Upload malicious content, viruses, or harmful code

6. Data Ownership

You retain ownership of all farm data, observations, and imagery you upload to the Service. By using the Service, you grant us a limited license to process, analyze, and store your data solely for the purpose of providing the Service to you.

We may use anonymized, aggregated data (with no personally identifiable information) to improve our machine learning models and platform features.

7. Satellite Data and Third-Party Services

The Service relies on satellite imagery and data from third-party providers including Google Earth Engine, Copernicus/ESA (Sentinel), NASA, and others. Availability and accuracy of satellite data may vary due to weather conditions, satellite coverage, and provider limitations. We do not guarantee continuous availability of satellite data.

8. AI-Generated Content

The Service uses artificial intelligence to generate agricultural analysis, recommendations, and reports. AI-generated content is provided for informational purposes only and should not be considered as professional agronomic advice. We recommend consulting with qualified agricultural experts for critical farming decisions. We are not liable for outcomes resulting from reliance on AI-generated recommendations.

9. Credit Scoring Disclaimer

Agricultural credit scores generated by the Service are indicative assessments based on satellite and farm data. They are not formal credit ratings and should not be the sole basis for lending decisions. Financial institutions using our credit scoring API are responsible for their own due diligence and lending criteria.

10. Limitation of Liability

To the maximum extent permitted by law, Time Hole Technologies Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of crops, revenue, or data, arising from your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability. We will provide reasonable notice for planned downtime when possible.

12. Termination

We may suspend or terminate your account if you violate these Terms or engage in activity that harms the Service or other users. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately, though we may retain your data as required by law or for legitimate business purposes.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via the Service or email. Your continued use after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Nigeria.
